Here is a letter that I sent to my DHS worker.
Any supportive information or answers will be appreciated.

Hi Kandi, Brady and I have a big problem and we need help. I am pasting an e-mail that I sent to a lawyer I found online but who is from portland. I really need you to read this and let me know what we can do to recover Brady and prevent this from happening again.

My 6 yr old son was born in Hawaii in 2002, I am a single father and have raised him alone since 2004 and due to the economy in Michigan, My son and I and I returned to a family homestead Downeast to be closer to my family as opposed to looking for new ground. My son and I are the only residents in our home. I have sole custody and have permitted visitation to mother during summer and spring albeit spring visits Never happened…. She never came to us. I took him to Maine or met 1/2 way for the summer trips.

Since I have returned to Maine My son is in school and we are adjusting well, My son is active and diagnosed ADHD he injures himself often “Minor” Thank goodness. But none the less I took him to his mother for a july visit and wound up being served a PPO by her in behalf of my son. She took him to a Dr and the Doc says that he has bruises that could be caused by abuse. He told his mom that dad gets mad at me…. He is a good kid and is treated well by everyone especially me. We love each other and we are kind to each other. Fact is that my son was playing in a tree with one of his friends before we went to see her and a week or two prior had Klanged himself but good in a rock at a birthday party. There were several adults present. If there are genuine signes of abuse then I fear that he may have been mishandled by his mother or another family member. I have no way of knowing.

I cannot see or talk to his mother until court date on 7-20-09 according to PPO. It appears that I am completely out of the loop. The things she said about me in the ppo statement are inconsionable and untrue. I feel that I need to hire an attorney and I am at a loss. Our custody case was filed and executed in Michigan.

How can his estranged mother take control of him like this? I fear that it is going to cause us serious financial hardship at the very least and I was not consulted by the Dr or his mother about this.

My opinion is that it is a very reckless immature desperate attempt to vindicate herself emotionally by hurting me and taking a pot shot at getting custody of her son.

Am I in Trouble here?

Sir, if nothing else,
PLEASE help me to select the right and respected attorney in Houlton Maine to recover from this as well and finally as possible.

Kind Regards, Feeling quite manipulated.
Steven
The claims of abuse are unsubstantiated. Let me clarify that I do not hurt my child. Please provide feedback based on experience or knowledge.
Indeed, He Loves his mother. He is desperate to please her. He has been in Maine since March and only seen his mother 3 times and they were only weekend visits. He has a new sister who his mom is now raising alone since she has declared herself to have an absolute dislike for men and kicked her husband out of the house. No Kidding, Genuine Bipolar. The whole story is too much. She is a genuine liar. and Yes I do get mad at him. But When I am mad, I make it clear by using my upset voice and non abusive redirection.
I hear you. That really hits home. And Believe me His mother knows this.

How do I move into a new area of law. Please Help?

September 9th, 2010
stuartdorf asked:

I have been a banking and real estate attorney in Illinois and Michigan. I know the future of my job is more then uncertain and living in Michigan only makes it worse.

I need advice as to how to transition into a new practice area, i.e. energy law, healthcare law. I do have a high skill set, so I would not literally be starting from scratch.

With a wife and young child I need some guidance. Any answers would be much appreciated.

Thank you.

Denied Change of Domicile by Referee in Michigan?

August 20th, 2010
danielle r asked:

I have two children and moved from Michigan to California. I was unemployed in Michigan and my parents suggested I move to California and stay with them and look for a job. I found a job in California before I moved from Michigan and then filed a motion for change of domicile. Unfortunately, I had to leave my children in Michigan with their father until I went to court in front of the referee. We went to court and my motion has been denied, even though I have more custody then my ex-husband, and I was employed and he was not. The referee denied the case because he thought I could have found work in Michigan and I should have looked harder. So basically he thinks it would be better for my children to stay and Michigan and for me to move back with no source of income and no place to live vs. me living with my parents while trying to save up money to buy a home for me and my children.

My question is, has anyone ever appealed a referee’s decision to change domicile in Michigan? I would go before a judge, however it cost alot of money for attorney fees, I’m not sure if its worth it. Any suggestions?

Michigan paternity for a child born in a marriage but not of the marriage?

July 23rd, 2010
GaRy asked:

Ok For months now I’ve been trying to find help. I don’t have money for a private attorney and legal aid tells me there’s nothing I can do. I have a child with a woman who is legally married in michigan. I have a legal DNA test proving that he is my child. However I have no means for a private attorney who can get this into the courts for me. I’ve called the friend of the court the prosecutors office legal aid and private attorneys. The only ones that will help are the Private attorneys but i can not afford to pay one to represent me. So is there any way I can establish paternity without paying money that I don’t have? The husband doesn’t seem to want to do anything about it and neither does my son’s mother. So i’m hoping someone out here can give me some information or something that will help me.
What i’m trying to do is to establish paternity so that I’m the child’s legal father and I have visitation rights. I’ve been to the court house to the friend of the court. They told me that I can’t petition through them because he has a legal father and that unless he dis establishes paternity I can’t establish it without a lawyer. I can afford to support my child. I work an almost full time job and buy whatever is needed for him. But I can’t afford to give someone 3,000 dollars just to get my name on the birth certificate. The test that I did was through a legal DNA testing company that I got the name from the person at the court house. I paid 500 bucks just to get it done and be satisfying to the courts.

How can I make sure my ex-wife gets Audited by the State of Michigan and IRS?

November 16th, 2009
Phillip C asked:

I have taken my ex-wife to Court in front of the “Friend” of the Court in Michigan. During the proceedings, my ex-wife admitted to making between $75K and $80K as a bartender. However, we were able to obtain her tax returns on which she claimed she only made $7K. When asked about the discrepancies, she asserted her rights under the 5th Amendment. The referee granted me child support and stated that her income was not determinable. The judge in the case stated that they have to go by the W-2′s and not the other evidence that was presented (even her own testimony) to determine attorney fees. The judge stated that the IRS and the State of Michigan haven’t thought it was an issue so it would not be an issue in her courtroom. So, I am left with no option but to make sure she gets audited in order to prove fraud. I have sent countless letters to the State of Michigan Treasury department and the IRS with all of the relevant evidence. Does anyone have any other way to insure an audit?

need advice from attorney or anyone who know about divorce laws?

November 2nd, 2009
Debbie asked:

I live in Michigan. got served divorse papers today, can’t afford an attorney and don’t qualify for free advice. got married 10 years ago,had a child and due to myself being abused left after 3 years. We stayed married because he said he would on day inherit money and after 10 years that is a reality as his father has passed. Now I get served and he wants to, get his, have his child support lowered from $109 a month and my child doesn’t get any of this inheritence. What do I do? I don’t want his money but want my child support. He has hidden his money from the court and says there is none.
to Colleen who stated for me to get a job, I HAVE ONE! I didn’t say I didn’t work, I do. I just don’t have the $1000 retainer the lawyers want.

In Michigan, USA how long it takes before a civil case judgment expires for collection?

July 3rd, 2009
Grapewine Taste asked:

I was the respondant and won a civil case judgment in a private suit with another person for over $10,000 in attorney fees etc. in 2001 and the person appealed that judgment but didn’t win the appeal. I never went further to court for more orders to enforce that judgment to collect from the other party in all these years. Collection agency was not able to collect it for me. How long I have before that judgment expires and I can no longer legally be able to collect that judgment from the losing party? The other person lives in another state, California, now. Is there a statue of limitation in Michigan on civil judgments? Any Michigan civil good lawyers’ here to help me with this question, I promise I won’t hold anyone responsible for his or her advice on this. Thanks.
